TVS840 surge

I've got a TVS840 two stroke on a Snapper mower. The engine has a surge to it when level, but if you tilt the mower back toward it's handle the surge goes away. The governor shaft seal does appear to be leaking, would that cause this problem, or is it a carb issue? The engine has 70 p.s.i. cold compression (not a whole lot).

Problem could be due to the float being out of adjustment. the leaking seal shouldn't effect it much, since the air leak would be constant.

Dang I was hoping the float level wasn't the issue, as I don't have the go-no-go gauge, Tecumseh part# 670253.

If you don't want to mess with the carb, you can replace it for $20.
